Upon arrest, the law enforcement officer did not read me my Miranda Rights. Does this affect my case?
In 1966 the United States Supreme Court declared that whenever an individual is taken into police custody, he or she must be informed of their Fifth Amendment rights. Before being questioned, the law enforcement officer is required to inform the individual of the following rights:
- The right to remain silent
- Anything you say or do may be used against you in a court of law
- The right to an attorney
- If you cannot afford an attorney one will be appointed to you
If a law enforcement officer fails to advise an individual of their Miranda Rights, all self-incriminating statements made by the individual in question cannot be used against them in criminal court. In addition, any evidence found as a result of the involuntary confession will likely be removed from the case.
What is the difference between juvenile court and criminal court?
Each state has set a maximum juvenile age. When an individual who is under the state's age limit commits a crime, they are given special protection and do not have all the same constitutional rights as an adult may have. Juvenile court procedures desire to rehabilitate the juvenile delinquent rather than punish them as they would an adult. However, there are certain cases in which a juvenile may commit a violent or serious crime and consequently be tried as an adult despite their age. When charged as an adult, the individual will face the same harsh penalties to which any other offender would be sentenced. If the juvenile offender is charged as a minor, the court system will most often focus on rehabilitation of the convicted individual. In other words, in an effort to divert the juvenile from future illegal and dangerous habits, the court will seek to restore the offender by requiring:
- Counseling
- Meetings with a probation officer
- Regular community service

Why should I hire a private attorney?
When you are arrested for a criminal offense, the law enforcement officer performing the arrest will inform you of your rights under the Fifth Amendment. These Miranda Rights include your right to an attorney. If you cannot afford a lawyer, the state will provide you with a public attorney. We urge you to avoid this option unless it is an absolute necessity. Public offenders are assigned to numerous cases at once and will not give your case the attention it deserves. They are overworked and unable to offer you the personalized and effective defense strategies that a private lawyer can offer. Our private legal professionals will stand by your side every step of the way and tirelessly work to protect your rights, future, and freedom.
